PSARA Review by MHA

Today a delegation of CAPSI attended a meeting convened by
Shri Sanjeev Kumar Jindal Additional Secretary MHA at North Block. He told that government is planning to review the governance and compliance issues of the PSARA. He said that the his ministry is interested in addressing industry issues by making necessary changes in the rules and Act. He asked CAPSI to make a comprehensive proposal to the MHA. A detailed discussion was held where all issues related to renewal of licenses, police verification, GST, Arms Licenses , National PSARA licensing and timely payment by service takers and training of security guards. Delegates also raised the Maharashtra Guard Board issues.
Ms Kriti Garg IAS also attended the meeting.
Sh Mahesh Sharma, Sh Vikram Mahurkar, Sh Anil Puri , Sh Sudhir Bhasin, Brig Baldev Singh and Ms Lydia participated in the discussions. Meeting was also attended by Sh Gurcharan Singh of SAI, Sh Namesh Dave & Ashwani Kaushik of RRU, Sh G B Singh & Ashutosh Jha of FICCI.
For the many years CAPSI have been insisting MHA to consider making amendments in the Private Security Agencies Regulation Act . We suggested the there is need to make basic changes like setting up multiple member National Regulatory Board and State Regulatory Boards where due representation should be given to the CAPSI and other stakeholders.

CAPSI – ASIS:
Sh Mahesh Singh Chauhan CPP , newly elected President of ASIS New Delhi visited our headquarters. We help discussions on various topics of mutual interests and decided to collaborate on our Surakshit – Vikshit Bharat-2047. He assured total support for Joint Security Innovation Centre and Task Forces constituted to strengthen our Citizens Security Culture mission.
We agreed to sign an MoU to formalise our relationship and areas of cooperation & collaboration.

MHA MEETING:
Mr Kitika Garg IAS of MHA invited us to discuss PSARA related issues. MHA is planning to conduct a comprehensive review of the PSARA so that all issues of the industry can be addressed appropriately. The idea as explained by MHA designated bureaucrat is to ensure Ease of Doing Business for growth and better governance .
We have been requesting MHA to conduct this exercise for the larger benefit of the PSI and good governance. A representation was submitted to the Home Minister and Home Secretary .
Resultantly , the exercise has started. The meeting went on for 1.30 hours. We raised all our pain points like GST, Training , Payment by Clients, amendments in PSARA and its rules and future of PSI. Ms Garg was very receptive and supporting . She also informed that the grand review of the PSARA is being undertaken on the instructions of Hon’ble Home Minister and the time given is “ Within One Month” Two officials of the rank of Directors of MHA has been assigned to work on this assignment.
We have been asked to remain in contact with MHA designated officials so that the exercise can be concluded within the stipulated timeframe.
Ms Rinku Lamba shall be contacting NOBs and State Chapter Presidents to seek their views.

It’s not just a gathering; it’s the start of a movement. A mission to build a society where parents no longer fear for their daughters, where no woman has to map her safety before stepping out, and where the gender of a child is no longer a factor of fate.

Can you recall the night the news of Nirbhaya broke your heart? The helpless rage, the silent tears, the unshakable pit in your stomach? As a mother, perhaps you held your daughter closer, silently asking, “How do I shield her from such a world?”

Central Association of Private Security Industry (CAPSI)and Security Association of Singapore (SAS) Forge Strategic Partnership to Strengthen Global Security Standards
CAPSI and the Security Association of Singapore (SAS) have officially signed a landmark Memorandum of Understanding (MoU) to collaborate on enhancing global security practices and fostering innovation in the private security sector. The agreement marks a significant milestone in fostering international cooperation to address evolving security challenges.
The MoU was signed during a special ceremony held in CAPSI Headquarter, New Delhi. The MoU was signed by Kunwar Vikram Singh Chairman CAPSI and Mr. Raj Joshua Thomas Member of Parliament & President, Security Association of Singapore. Mr. Jourdan Sabapathy, Chief of Staff and Mr. Raymond Lee, Executive Director SAS
Sh.Sudhir Bhasin National Vice President, CAPSI, Anil Dhawan, National Vice President, CAPSI, Brig. Baldev Singh, Member of Governing Council, CAPSI and Shri Bhagwan Shankar IAS ( R) Advisor CAPSI joined the signing of the MoU.

The GOLDEN GUARDS AWARDS will be presented during the 19th Security Leadership Summit on 22nd November 2024 in New Delhi. Member companies are encouraged to nominate up to five security guards for this esteemed recognition. The award will be presented to the Owner, Director, or CEO of the company, along with the nominated security guards.

Had the opportunity to represent CAPSI – National along with office Bearers of CAPSI – Punjab Chapter namely Mr. Harinder Singh, Mr. Baldev Singh Thind, Mr. Manjeet Singh Cheema, Mr. Raghuinder Singh Kairon and Mrs Kinshuka Sethi @ the 1st Stake Holders Conference of Punjab on PSAR Act, initiated by CII in partnership with Punjab Police. The conference was presided over by the ADGP – Security & Controlling Aunthority (CA) Punjab, Mr. S.S. Srivastava alongwith Mr. Abhishek Gupta, Chairman CII Punjab State. The conference was attended by a no.of luminaries Mr. DPS Kharbanda (IAS) Secretary Industries, Commerce & Investment Promotion Punjab, Mr. Gurkirat Kirpal Singh (IAS) Principal Secretary Department of Home Affairs and Justice, Govt. Of Punjab, Mr. A.S. Rai ADGP Traffic – Punjab, Mr. Shive Kumar Verma ADGP – IS – Punjab, Mr. Ishwar Singh – Spl DGP (HRD) – Punjab, Ms. Kinshuka Sethi – CAPSI Punjab, Mr. Sarabhot S Sidhu ALC, Maj Gen Harmandeep Singh MD PESCO, Col GPS Virk and many more. Was able to interact with all present and was able to put forth the pain points which are affecting the PSA’s. The CA was an amiable gentleman and was receptive to all suggestions. I personally was able to apprise the gathering of what CAPSI stood for and the role CAPSI has played in the past and continues to do, in safeguarding and promoting the interests of PSI pan India through continous deliberations with MHA – Centre and State (through various State Chapters) and other stakeholders like GST, ESI, PF, Labour Dept etc. I requested the CA if Punjab Police could have bi-annual townhall to discuss the problems faced by PSI as also to discuss different avenues of how the PSI can help Punjab Police in securing the State. Ms. Kinshuka Sethi gave a wonderful presentation on Women’s role in PSI – Trends & Future predictions. Overall the event was very nicely managed and attended. Special mention needs to be made of the efforts put in by Inspector (Ms.) Rushika from the CA’s office, in making this event a success and the team of CII – Punjab.

Today attended Board meeting at 99 th annual conference of World Association of Detectives being held at Kuala Lumpur Malaysia under the leadership of Sh RP Chauhan President WAD.35 members from India are participating. Amazing strength. Dr RK Tyagi and Bhaskar Reddy as Area Governors did a very commendable job.

GST ISSUE:
Today we met Sh Sachin Jain IRS Joint Secretary ( TRU-2) who is incharge officers for the GST matters.
We made our presentation for the grant of RCM for the all Body Corporates. He was well aware of the huge cash flow problem we are facing due. He suggested that our state chapter units MUST meet their GST COMMISSIONERS immediately and present our case for RCM. Convince them so well that they take our side at the forthcoming meeting of the GST COUNCIL taking place on September 07-08 2024.
A draft of the letter to be submitted to GST Commissioner is being sent to you on your email. It must be signed by State President and his team. This exercise must be completed before 4th of September. Immediately seek appointment with him and get it done. Must tell him that if we are denied RCM them PSI will collapse causing closure of hundreds of private security agencies and loss of job for lakhs of security guards.

BIS MEETING:
The Bureau of Indian Standards is moving forward towards standardising Private Security Service Delivery .
Meeting was held yesterday at BIS Hqs. Officials of MHA and other stakeholders participated in person and virtually. Few changes were made. Amended draft shall be circulated to members of the panel. Once finalised , the proposed Standards for PSI shall be made public for any suggestion/s. This will give opportunity to all members to understand the BIS Standards which are based on PSARA.

2nd Round Table Conference was convened at the Constitution Club of India, focusing on the national project to evolve a National Citizens Security Culture. Eminent Security professionals from various sectors, including multinational companies, major hospitals, educational institutions, cinemaplexes, cyber security firms, and risk consulting companies gathered to deliberate on the aims and objectives of this vital initiative.

Key highlights of the conference included the presentation of the Integrated Security Grid architecture by Lt Gen A B Shivane, which aims to enhance coordination and efficiency in security measures across different sectors. Sh Bhagwan Shankar, IAS (Retd.), emphasized the active support from the Ministry of Home Affairs (MHA) and its associated bodies, including the Bureau of Police Research and Development (BPR&D) and Rashtriya Raksha University, in fostering a comprehensive security framework.

Harvinder Singh, Chairman of ASIS, expressed his organization’s commitment to providing total support for the initiative. Sh Rajneesh Gupta, IPS, Joint Commissioner of Police, Special Branch presided over the conference .He lauded the efforts undertaken by the CAPSI and assured the active support and participation of the Delhi Police in this national endeavor.

The conference marked a significant step towards strengthening the country’s security infrastructure and fostering collaboration among various stakeholders to ensure a safer environment for all citizens.

Kunwar Vikram Singh Unanimously Re-elected as Chairman of CAPSI

New Delhi, June 07- The Central Association of Private Security Industry (CAPSI) is delighted to announce the re-election of Kunwar Vikram Singh as Chairman during the recent meeting of the Governing Council, held at PHD House, New Delhi. The decision was reached unanimously by the members present at the meeting, including representatives from 22 State chapters.

The day-long proceedings witnessed active participation from Council members who expressed their unwavering support for Kunwar Vikram Singh’s leadership and vision for the development of the private security industry in India. Recognizing his successful tenure and remarkable achievements, the Governing Council reaffirmed their trust in his ability to guide CAPSI towards continuous growth and excellence.

In addition to the re-election, the Governing Council made a significant decision to support the National Citizens Security Culture initiative. CAPSI recognizes the importance of creating a strong sense of national security among citizens, promoting awareness, and fostering a culture of safety and security. By aligning with the National Citizens Security Culture campaign, CAPSI aims to play a pivotal role in making India a safer and more secure nation for all.

Furthermore, the Governing Council unanimously endorsed the “Stay Alert – Stay Secure” program. First Round Table convened to discuss National Citizens Security Culture received tremendous support for 58 eminent personalities who deliberated during day long meeting held at Constitution Club of India. They all agreed on the following;

1. Develop methodologies and processes for promoting national Citizens security culture.
2. Create public awareness events to educate citizens about security threats and the importance of personal and national security.
3. Establish government engagement strategies to facilitate collaboration between authorities, citizens, and relevant stakeholders.
4. Emphasize the role of universities in fostering a culture of security through research, education, and community engagement.
5. Facilitate the active involvement of civil society organizations in promoting citizen participation and empowerment in national security efforts.
We shall be forming expert groups to discuss methodologies to achieve objectives of the national movement. The report of the Round Table will be shared on social media for larger participation of Citizens of India.

MARITIME SECURITY- CAPSI INITIATIVE:

Met Sh Sarbananda Sonowal Hon’ble Union Cabinet Minister for Shipping,Ports & Waterways at his office and presented a proposal for Maritime Security. He appreciated our proposal and promised to have it examined.

India being a coastal nation and heavily dependent on maritime trade, the importance of maritime security has been increasing significantly. The government has emphasized strengthening measures to protect its coastal areas and shipping lanes, making it an opportune time to establish training centers.
There is a growing demand for well-trained and skilled personnel in maritime security due to the evolving threats and challenges faced in the maritime domain. Training centers can bridge this gap by offering comprehensive courses on maritime security, including counter-piracy operations and vessel protection.

Today a delegation of CAPSI met
Sushri Shobha Karandlaje Hon’ble Minister of State for Labour & MSME at her office. We raised the issue of disparity in the Code of Wages Act. She understood our serious concerns and promised to discuss this matter with Union Cabinet Minister Sh Mansukh Manadivya. Soon we shall also be meeting the Union Cabinet Minister. Sh Vishwanath Katti President. Sh Mahesh Sharma Secretly General, Sh Anil Puri Vice President, Sh Sudhir Bhasin Vice President, Brig Baldev Singh Member Governing Council, Capt Tiger Collaco Director ( Projects) and Ms Lydia (Manager Projects) formed the CAPSI delegation.

Central Association of Private Security Industry – Recent Disparity in Payment Provisions under the Code of Wages Act

New Delhi – The Central Association of Private Security Industry (CAPSI) has raised concerns about a serious anomaly within the provisions of the Code of Wages Act. This anomaly has created an imbalance in the payment process between principal employers and contractors, potentially leading to dire consequences for service providers across the country. CAPSI has made a representation to the Prime Minister and the Labour Minister, urging their immediate attention.

This issue imposes a significant financial burden on service providers, particularly small and medium enterprises (SMEs), and requires prompt intervention. If not resolved, thousands of Private Security Agencies will face Shut Down if payment provisions not amended.

Under the current provisions of the Code of Wages Act, principal employers are required to clear invoices issued by contractors by the 7th of each month. Meanwhile, contractors must pay wages to their employees by the 10th of each month or face penalties. Unfortunately, there are no penalties for principal employers if they fail to pay contractors by the specified deadline, creating an imbalance that adversely affects service providers.

The Central Association of Private Security Industry calls for the introduction of penalties for principal employers who do not meet their payment obligations.

Kunwar Vikram Singh, Chairman CAPSI said, establishing a fair and equitable framework that holds both principal employers and contractors accountable for timely payments is essential. This change will safeguard the interests of service providers and foster a healthy business environment, contributing to the overall growth and development of the economy.

We remain optimistic that under the leadership of the Hon’ble Prime Minister and Hon’ble Minister of Labour, the necessary amendments will be made to ensure the welfare and prosperity of all stakeholders involved.

MEETING WITH HOME MINISTER:

Dear Friends,
Yesterday we met Sh Bandi Sanjay Kumar Hon’ble Minister of State for Home Affairs at his office at North Block. I briefed him about the activities od the CAPSI and presented our annual report along with report on North East Initiative. He was also briefed about National Citizens Security Culture and the role being played by MHA. We emphasised on the pending amendments in the PSARA . We also informed him about the expected negative impact on the entire PSI if the certain clauses of the Code of Wage Act are not amended immediately. A representation was handed over to him with the request that he must take up this matter immediately with the Hon’ble Minister of Labour & Employment and fine way to save the PSI from major disaster. He understood our issue and promised to take up the matter.
He assured that he shall be calling a meeting of the concerned MHA official to discuss all matters raised by CAPSI.
It was indeed a very meaningful meeting with the Hon’ble Minister.

Appointment of Sh. Anil Pratham IPS (Retd) as Strategic Advisor of CAPSI

I am pleased to announce the appointment of Sh. Anil Pratham, IPS (Retd), former DGP, as the Strategic Advisor of the Central Association of Private Security Industry (CAPSI). Sh. In his new role, Sh.
